The symbol that we use as the Logo for our organization is obtained from Mr. Yash Lohana (Director), who has designed it and we declare that our usage is based on a license agreement.
This Logo has been applied for Trademark Registration by its owner, and the following declaration is made with the owner of the trademark.
As informed by the legal advisor, consultant and expert in IP Laws. There is no legal significance to the ™ Mark. It just indicates that there is an application filed for the Trademark. Also, there is no such statements found in the literature, we perused which states that one may stop using the ™ mark for any reason, specific and general which is in perview of law and logic. Also, it is understood that this right is independent of the outcome or result of the application. The approval or rejection of the trademark application is immaterial in this regard. Also, this symbol signifies that an application for the trademark has already filed. Hence, no one else can again apply for the same.
This also resolves for the scenario wherein, if a trademark registration application for a party who initially applied is rejected, and if the same is registered for another party who applied later, then a conflict would be created and the validity of the grounds on which the trademark was not registered initially would be challenged. Ideally, this should not happen, hence, the use of such symbol is necessary to avoid multiple applications of same trademark.
As there is no legal binding or obligation for the ™ mark, which we use. It is not illegal as we are eligible after having applied for the trademark. Everyone who is a part of and write on behalf of, the organization use the ™ symbol and represent the Application ID wherever it is reasonable.
